Privacy Policy

IMPORTANT: NitaCare is a wellness companion app, not a medical device. This Privacy Policy explains how NITA CARE LLC collects, uses, stores, and protects your information.

If you grant permission, the App may read health and fitness data from Apple HealthKit (iOS), including step counts, heart rate, sleep analysis, and other wellness metrics you choose to share. We do not write to HealthKit without your explicit consent.

2. How We Use Your Information

We use your information to provide and improve the Nita wellness companion experience, power the Nita AI (your conversation history and wellness logs are sent to Anthropic's Claude API), generate wellness insights, send opted-in notifications, respond to support requests, and comply with applicable laws.

We do NOT sell your personal data, provide medical diagnoses, train AI models on your personal health data without explicit consent, or serve targeted advertising.

3. Data Storage and Security

Your data is stored on Supabase (PostgreSQL), hosted in the United States. We use TLS 1.2+ for data in transit and encryption at rest. If you delete your account, we initiate a 30-day grace period, after which your data is permanently deleted. Contact legal@nita.care to request immediate deletion.

4. AI Processing and Third-Party Services

Anthropic Claude API

The Nita AI is powered by Anthropic's Claude API. When you send messages to Nita, your message text and relevant wellness context are transmitted to Anthropic's servers for processing. We do not include your full name or email address in AI requests.

OpenAI (Voice Features)

Voice input and audio playback are processed using OpenAI's Whisper and TTS APIs. OpenAI's privacy policy governs their handling of audio data.

Apple HealthKit

Health data accessed via Apple HealthKit is never shared with third parties for advertising or marketing purposes.

Weather Data (OpenWeatherMap)

If you enable weather features, your device's approximate location (latitude and longitude) is sent to our servers, which request current weather conditions from OpenWeatherMap on your behalf. This location data is used only to return a weather forecast and is not stored on our servers or shared with OpenWeatherMap for any other purpose.

Email Delivery (Resend)

Account-related emails (such as welcome messages, weekly summaries, and deletion confirmations) are sent through Resend, a transactional email provider. Resend processes your email address solely to deliver these messages.

Feedback Form (Formspree)

If you submit feedback through our website's feedback forms, the information you enter (including your message, an optional screenshot, and, if provided, your email address) is processed by Formspree, a third-party form-processing service, solely to deliver your feedback to us.

5. Your Privacy Rights

California Residents (CCPA/CPRA)

You have the right to know what personal information we collect, to delete it, to correct inaccuracies, and to opt out of the sale or sharing of personal information (we do not sell your data).

EU/EEA Residents (GDPR)

You have rights of access, rectification, erasure, data portability, and restriction of processing. Our legal basis for processing health-related wellness data is your explicit consent, which you may withdraw at any time by deleting your account.

6. Children's Privacy

Nita is intended for adults 18 and older only. It is not directed at, marketed to, or intended for use by children or teenagers, and we do not knowingly collect personal information from anyone under 18. If we learn that we've collected information from someone under 18, we will delete it.

7. Crisis Safety

If you express thoughts of self-harm or suicide through the App, Nita is designed to direct you to crisis resources, including the 988 Suicide and Crisis Lifeline (or your region's local emergency and crisis resources). In an emergency, call 911 (or your local emergency number) immediately.

If you use the App's SOS feature, your device's current GPS location is sent directly from your device to your chosen emergency contact(s) via SMS text message. This location data goes directly from your device to your contact's phone through your device's SMS service — it does not pass through or get stored on our servers.

8. Changes to This Policy

We may update this Privacy Policy and will notify you of material changes through the App or by email.
