1. About Nita
NITA CARE LLC operates the Nita mobile application, a personal wellness companion designed to help you log and reflect on your health habits. Nita is a wellness tool only — not a medical device, clinical service, or substitute for professional medical advice.
2. Important Health Disclaimer
- Nita is NOT a medical device and has not been evaluated or cleared by the FDA
- Nita does NOT provide medical advice, diagnosis, or treatment
- Nothing from the Nita AI should be interpreted as medical advice
- Always consult a qualified healthcare professional before making health decisions
- In a medical emergency, call 911 immediately — do not use this App
3. Eligibility
You must be at least 13 years old to use Nita. By using the App, you represent that you meet this requirement. Users between 13 and 18 represent that a parent or guardian has reviewed and agreed to these Terms.
4. Account Registration
You are responsible for providing accurate registration information, maintaining the confidentiality of your credentials, and all activity under your account. Notify us immediately at legal@nita.care if you suspect unauthorized access.
5. The Nita AI Wellness Companion
The Nita AI is powered by large language model technology for general wellness reflection only. Nita AI responses may be inaccurate or inappropriate for your circumstances. Nita is not a therapist, counselor, physician, or licensed healthcare provider. Do not make health or medical decisions based on Nita AI responses.
6. Crisis Safety Policy
If you express thoughts of suicide or self-harm within the App, Nita will direct you to crisis resources. Call or text 988 (Suicide and Crisis Lifeline), text HOME to 741741 (Crisis Text Line), or call 911 for immediate danger.
7. Acceptable Use
You agree not to use the App for any illegal purpose, attempt to reverse engineer the App, use the App to store or transmit malicious code, or misrepresent your identity.
8. Subscription and Payments
Subscriptions auto-renew unless cancelled at least 24 hours before the renewal date. Refunds are governed by Apple App Store or Google Play policies.
9. Intellectual Property
All content and functionality of the App is owned by NITA CARE LLC. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial wellness purposes only.
10. Your Content
You retain ownership of the wellness data you input. By using the App, you grant NITA CARE LLC a limited license to store and process your content solely to provide the App's services.
11. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NITA CARE LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.
13. Governing Law
These Terms are governed by the laws of the State of Ohio, without regard to conflict of law principles. Disputes shall be resolved through binding arbitration under AAA Consumer Arbitration Rules.
14. Changes to These Terms
We may update these Terms and will notify you of material changes through the App or by email.
