This End User License Agreement ('EULA') is a legal agreement between you and NITA CARE LLC governing your use of the Nita mobile application. By downloading, installing, or using the App, you agree to be bound by this EULA.
1. Grant of License
NITA CARE LLC grants you a limited, non-exclusive, non-transferable, revocable license to download and install the App on mobile devices you own or control, and use the App for personal, non-commercial wellness purposes.
2. License Restrictions
You may NOT copy, modify, or create derivative works of the App; reverse engineer or decompile the App; remove proprietary notices; use the App for commercial purposes; transfer or sublicense your rights; or attempt to circumvent technical protection measures.
3. Intellectual Property
The App, including all content, features, software, the Nita AI persona, and associated branding, is owned by NITA CARE LLC and protected by applicable intellectual property laws. The 'Nita' name and associated branding are trademarks of NITA CARE LLC.
4. Your Data and Content
You retain ownership of the personal wellness data you input. You grant NITA CARE LLC a limited, royalty-free license to store, process, and display your content solely to operate the App. We will not use your identifiable health data to train AI models without your explicit opt-in consent.
5. Third-Party Services
The App integrates with Anthropic (AI), OpenAI (voice), Supabase (database), and Apple/Google (platforms). Your use of these integrations is subject to their respective terms and privacy policies.
6. App Store Terms
This EULA is between you and NITA CARE LLC only, not Apple Inc. or Google LLC. Apple and Google have no obligation to provide maintenance or support for the App.
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NITA CARE LLC SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES. TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED $50 USD OR THE AMOUNT YOU PAID IN THE PRECEDING 12 MONTHS.
9. Governing Law
This EULA is governed by the laws of the State of Ohio, United States, without regard to conflict of law principles.
